Kiddee cases are made by the Hong Kong-based PMS International and, like Trunki cases, are decorated to look like animals.

The informed user is deemed to be knowledgeable in the relevant design field and able to make a side-by-side impression. e. not exactly the same as a design known to the public – and it should produce a different overall impression on the informed user (the same test as discussed above with relation to infringement). Unfortunately for Magmatic, design registrations cannot (and were never intended to) prevent a competitor from copying the underlying concept. Even where the registered design does not have surface decoration, the surface decoration on the allegedly infringing item may give rise to a different overall impression.The Supreme Court upheld the decision of the Court of Appeal to the effect that there was no infringement of the Community registered design for Magamatic's Trunki suitcase by PMS's "Kiddee" suitcase, which copied the idea but not the design as registered. If the predominant colour of the first example of the Kiddee Case shown in para 4 above was the front part and was coloured red, then one would presumably compare it with the CRD on the basis that the CRD was principally coloured red, but that the wheels and spokes, strap and strips of the CRD were in a contrasting colour, and the Kiddee Case was differently coloured.The fact that the Trunki was both original and clever was not relevant in this case, although the Supreme Court reached this conclusion with some regret. Perhaps unsurprisingly this inspired a competitor, PMS, to create a rival product known as the Kiddee Case.
